Agreement to our Legal Terms

This document outlines the terms and service agreements for using Avio Bot and any other affiliated service, such as our website. Within this document is all the necessary information and details required to to comply with our usage requirements. By accessing or using the Avio Bot Application or any other service we provide, you agree to be bound by these Terms of Service and agree to hold responsibility for any misuse of our service. These terms apply to all users and server owners using our service.

IF YOU DO NOT AGREE WITH THESE TERMS, YOU ARE PROHIBITED FROM USING OUR SERVICE OR ANY OTHER SERVICE WE PROVIDE AND YOU MUST DISCONTINUE YOUR USE IMMEDIATELY.

Users may be updated via our Discord (https://aviobot.xyz/discord) about any TOS updates. However, it is your responsibility to ensure you have read our up-to-date terms.

These Terms shall be constructed in accordance with the laws of the United Kingdom of Great Britain and Nothern Ireland.

1. Definitions

  • "Avio", "we, "us" and "our" - The team behind the Avio Bot Discord Application and the aviobot.xyz website or other affiliated services.
  • "The Bot", "Bot", "Service" and "Application" - The official Avio Bot on the Discord Platform (https://discord.com), developed an managed within Scotland, United Kingdom (UK).
  • "Website" - The official website for the Avio Bot application, accessible at aviobot.xyz.
  • "the user" - Refers to any Discord account which interactions with the application.
  • "the guild" - Refers to any Discord server which the application is a member of.

2. Accessing Avio Bot

We reserve the right to revoke your access to the bot immediately, without advance notice or a particular reason. The suspension of your access to Avio Bot does not entitle you to any claims for compensation or reimbursement. Attempting to bypass or otherwise exempt yourself from suspension of our services will result in a further suspension, legal action, or permanent suspension from all current and future services.

You are not permitted to do the following:

  • Use the service if you are under 13 years old.
  • Use the service to engage in any illegal actions which violates the laws of The United Kingdom of Great Britain and Nothern Ireland or any other country.
  • Impersonate Avio Bot staff, developers, or affiliates.
  • Intentionally attempt to disrupt or bring down the service.
  • Spread false or misleading information about our staff or affiliates.
  • Cause any harm that negatively impacts the service.
  • Threaten, harm, or damage service staff or affiliates.
  • Copy, redistribute, or profit from any part of the service without explicit and written permission from Senior Staff members within Avio Bot.
  • Use the service in ways that violate the Discord Terms of Service or Discord Community Guidelines.

3. Collection of Data

While using the bot, we may collect data, such as serverIDs and userIDs, to operate the application and improve features. By using our service, you agree to the collection of this data. You can view how we use/store your data in our Privacy Policy.

4. Limitation of Liability

The application is provided on an "as is" and "as available" basis. We are unable to guarantee that your use of the application will be 100% safe, bug-free, or exempt from disruptions e.g. unexpected downtime. If deemed necessary, we may remove, discontinue or revoke your access to features within the service without advance notice, for a reason or no reason.

Our liability is limited to the maximum extent permitted by applicable law. Under no circumstances shall Avio Bot, its developers, staff or affiliates, be held liable for any direct, indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of the application. This includes, but is not limited to damages for loss of profits or other intangible losses, even if we have been advised prior about the possibilities of these damages.

5. Acceptable Use

Users are responsible for acknowledging if their use of our service violates any applicable laws of the United Kingdom of Great Britain and Nothern Ireland or any other country, or any Third-Party we utilise, including Discord.

We reserve the right, at our sole discretion, to take appropriate measures to protect legitimate interests, including but not limited to issuing warnings, temporarily restricting access, suspending, or permanently removing you ("the user") or your server ("the guild") from using the application or other services/applications we provide/operate if we believe your use violates these Terms of Service.

6. User Responsibilities

  • Users and server owners are responsible for ensuring the protection and security of their own account. You are responsible for any violation of these Terms of Service which occur on your account, whether it was you or not.
  • Users are responsible for ensuring they have permission to invite/use the application in their server. We will not be held accountable for any accidental invite of the application to servers. It is the responsbility of the server owner and/or server staff.
  • Users must comply with the Discord Community Guidelines at all times while using the application. Violation of this may subject you ("the user") and those involved to a termination from all services we provide (See Term 6. Termination).


    • 7. Termination

    If deemed necessary or required, we may suspend or terminate your access to the bot at any time, with a reason or no reason, with notice or without notice. We shall not be held responsible for any issues arising from your termination. We reserve the right to termination at all times. If terminated from our services, our liability is still limited to the maximium extent permitted by applicable law.


    8. Partnerships

    To become an Avio Bot partner and retain the partnership agreement, all members of party must comply with all the terms set forth in this document. All members of the party must also comply with the additional Partnership Terms of Service, found here.


    9. Accessing aviobot.xyz

    The website, accessible at aviobot.xyz, provides additional information and access to features within Avio Bot.
    By Using the website, you agree to follow all terms laid forth in this document, as well as other terms referenced throughout the website. Certain features (such as our Dashboard) will require you to log in with your Discord account. If you choose to login, you are also required to follow the Discord Terms of Service.
    The website is provided on an "as is" and "as available" basis. While we will try our best to ensure the website is online at all times, we are unable to guarantee 100% uptime.


    10. Changes to these Terms

    We reserve the right to change or modify these terms at our desire. It is your responsibility to ensure you are up-to-date with our current TOS. In certain circumstances, users may be contacted regarding any changes, modifications, or additions. All changes/modifications will take immediate effect, unless otherwise stated. By continuing to use Avio Bot, you are accepting these terms. If you wish to not follow any updated/modified terms, you should discontinue your use of our service immediately.
